REGENXBIO Says All Ongoing Patent Litigation Regarding Patents-In-Suit To Be Terminated With Prejudice; Agrees Not To Sue Sarepta Or Affiliates Over Existing Elevidys Or AAVrh74-Based Capsids

REGENXBIO Inc. has settled patent infringement litigation with Sarepta Therapeutics and Catalent, resolving claims related to U.S. Patent Nos. 10,526,617 and 11,680,274. As part of the settlement, Sarepta will pay REGENXBIO $39 million within 10 days, and all ongoing litigation regarding the patents will be terminated with prejudice. The agreement includes a covenant not to sue Sarepta for future claims related to its gene therapy products using AAVrh74-based capsids, while REGENXBIO also agrees not to sue Sarepta or its affiliates over existing ELEVIDYS products.
